Kaestner, Fielding, and State Income Taxation of Trusts sponsored by Endeavor Wealth Advisors
Please arrive at 11:30 am for networking time in advance of lunch.
Lunch will be served at 12:00pm (noon) with the meeting beginning at 12:20 pm.
About the Program
Last summer, the U.S. Supreme Court found in favor of the taxpayer when it held that North Carolina’s income taxation of a trust based solely on the residence of a beneficiary within the state was unconstitutional under the Due Process clause. This presentation will discuss the constitutional arguments raised in North Carolina Dept. of Revenue v. Kimberley Rice Kaestner 1992 Family Trust, Fielding v. Commissioner of Revenue, and the bases and differences in state income taxation of trusts.
About the Speaker
Maryann serves as Vice President and Legal Counsel for a family office outside of Cleveland. She advises family members on estate planning matters as well as provides counsel to the family's private trust company and other entities. Prior to joining the family office she spent her entire legal career at Schneider Smeltz Spieth Bell in Cleveland where she was a member of the Trusts & Estates and Tax practice groups. Her past experience includes working with individuals and families to develop estate plans using a range of simple and sophisticated estate planning methods, counsel to individual and corporate executors and trustees in the administration of trusts and estates, and the review and preparation of estate tax returns, gift and generation-skipping tax returns, and income tax returns for fiduciaries of trusts and estates. Her favorite area of practice is finding opportunities and solutions in complex trust administration matters. Maryann is currently serving as Treasurer of the Cleveland Metropolitan Bar Association Estate Planning, Probate & Trust Law Section and is a member of the Ohio State Bar Association Estate Planning, Trust, and Probate Law Section Council.
