About the program…
A lawyer undertaking advising a family and its business on financial, operational and organizational succession issues faces a myriad of conflicts and risks. Clients, accountants and financial services providers should be aware of the limitations on a lawyer’s representation of a family business, its owners and employees. Mr. Dickinson will discuss the ethical and legal issues arising in the representation of members of a family that owns or controls an operating business entity. He will focus on issues such as:
- Who does the attorney represent and to whom does he owe a duty?
- How does the attorney deal with confidential information?
- Who pays the bills and how are the services billed?
- What if the lawyer suspects that certain family members have diminished capacity?
- Is the representation on a continuing basis or a single engagement?
- Can conflicts of interest be waived?
About the speaker…
James G. Dickinson is a shareholder at Cavitch, Familo, Durkin Co., LPA and focuses his practice on corporate succession planning, general corporate matters and estate planning. He counsels clients on mergers and acquisitions, corporate structuring and asset protection planning. He also helps non-profits with tax planning, tax-exempt status and organizational structuring. Jim is a certified specialist in Estate Planning, Trust & Probate Law, a designation achieved only by an elite group of attorneys in the State of Ohio.
He is licensed to practice in both Ohio and Florida, and before the U.S. Tax Court as well. Jim is a popular guest speaker and his articles have appeared in numerous professional and legal journals. Continuing Education – EPC Cleveland will request credit for this program from the CFP® Board of Standards for CFP® designation holders. In addition, a certificate of completion will be available for those CTFAs, CPAs, and CWS designees who feel the program satisfies their continuing education requirements. This luncheon will also offer one hour of CLE and insurance credit.

Parking Options
Option 1: Reduced parking fees are available on a space-available basis at Ampco Euclid Gateway Garage (740 Euclid Ave., entrances on Euclid & Prospect) to those who enter after 11:01 am and exit before 2:29 pm. Guests should present ticket to the reception desk at The City Club for validation. After validation and if within the timing restrictions, the parking fee is $3.
Option 2: Through a special arrangement between The City Club and The Metropolitan at the 9 (2017 E. 9th Street, Cleveland, Ohio 44115), guests are able to take advantage of a $10 valet rate. To take advantage, tell the valet you are attending an event at The City Club. Once at The City Club, pick up a blue ticket from the reception desk. Present this ticket to the valet upon claiming your car. This option is available to those who park at or later than 11:01 and pick up their vehicle before 2:29 pm.
